What California Law Defines as Sexual Battery

California Penal Code 243.4 defines sexual battery as touching an intimate part of another person against their will for the purpose of sexual arousal, sexual gratification, or sexual abuse. Under the statute, intimate parts include the sexual organ, anus, groin, or buttocks of any person, and the breast of a female. For the misdemeanor form of the charge, skin-to-skin contact isn’t always required: touching through the victim’s clothing can qualify.

To convict, prosecutors must prove three elements beyond a reasonable doubt: the defendant touched an intimate part of another person; the touching was against that person’s will; and the touching was done for sexual arousal, gratification, or abuse. PC 243.4 doesn’t require penetration or sexual intercourse, which separates it from rape under PC 261. It’s also distinct from simple battery under PC 242 and from lewd acts on a child under PC 288. Other forms of the charge can be filed as a misdemeanor carrying up to one year in county jail, depending on the circumstances.
